End-of-Service Gratuity (severance pay) is a statutory benefit guaranteed to private-sector employees in the UAE under Federal Decree-Law No. 33 of 2021 on Regulation of Labour Relations. The revised labour legislation unified contracts into fixed-term agreements and eliminated the confusing unlimited contract resignation penalties that existed in previous laws.

1. Basic Eligibility Criteria

To qualify for end-of-service gratuity, an employee must have completed at least one full continuous year (365 calendar days) of service with their employer. Unpaid leave days taken during the tenure are deducted when computing continuous service length.

Key Benchmarks & Figures:

  • Less than 1 year of service: 0 entitlement.
  • 1 to 5 years of service: 21 days of basic salary for each completed year.
  • More than 5 years of service: 30 days of basic salary for each additional year beyond year 5.
  • Pro-rata calculation: Fractional portions of a year are calculated proportionally, provided the initial 1-year threshold has been met.

2. The Statutory Calculation Formula

The calculation is based strictly on your last drawn basic wage, divided by 30 to determine the daily basic wage.

Key Benchmarks & Figures:

  • Daily Basic Wage = Last Basic Salary ÷ 30
  • Years 1 to 5 = (Daily Basic Wage × 21) × Number of Years
  • Years 6+ = (Daily Basic Wage × 30) × Additional Years
  • Total Gratuity Cap: Cannot exceed the sum of two full years’ basic salary.

3. Resignation vs. Termination Under Current Law

Under the previous 1980 Labour Law, resigning from an unlimited contract resulted in severe gratuity reductions (one-third or two-thirds penalty). Under Federal Decree-Law No. 33 of 2021, as all contracts are standardized fixed-term contracts, an employee who resigns after completing 1 year of service and serving their contractual notice period (30 to 90 days) is entitled to full 100% gratuity.

Key Benchmarks & Figures:

  • Notice period compliance is mandatory.
  • The employer must disburse the gratuity and all pending benefits within 14 calendar days from the last working day.

4. Alternative Workplace Savings Schemes (DEWS & Voluntary Funds)

The UAE federal government and financial free zones (DIFC) have introduced defined-contribution voluntary savings schemes. Under these schemes, employers deposit a monthly percentage into regulated investment funds instead of paying a lump-sum gratuity at the end of employment.

Key Benchmarks & Figures:

  • DIFC DEWS Scheme: Mandatory in DIFC since 2020.
  • Federal Voluntary Alternative Scheme: Enacted via Cabinet Resolution No. 96 of 2023, allowing employers to opt into licensed investment funds.

Summary & Takeaway

Your gratuity is one of your most valuable financial assets in the UAE. Always ensure your contract specifies a fair basic salary and keep accurate records of your start date and official leaves.
